The patent system in Singapore operates on a first-to-file basis. Singapore provides three patent prosecution routes, namely: Local Route, Mixed Route, and Foreign Route. Noting that the Foreign Route will be phased out by Jan 1 2020, the following options shall thus focus on the Local Route and Mixed Route.
– Request for Grant of Patent
(Patent Form 1, SGD 160)
– Request for Patent Search within 13 months
(Patent Form 10, SGD 1,650)
– Request for Patent Search and Examination within 36 months
(Patent Form 11, SGD 1,650 – 1,950, plus SGD 40 for each claim in excess of 20)
– Request for Patent Examination within 36 months
(Patent Form 12, SGD 1,350)
A local route is a substantive search and/or examination that is performed by IPOS’ Patent Examiners. The preferred option is a combination of Search and Examination (PF 11). In the event of the unconventional request for Search only, independent of Examination (PF10), the 13 months dateline applies.
A mixed route is an option where the examination is performed by IPOS’ Patent Examiner who relies on the search report of a corresponding application. In this instance, a request for Examination within 36 months with PF12 shall apply.
